Thank you for visiting and using GoNetra (“Company,” “we,” “us,” or “our”). By accessing or using our website GoNetra.com (the “Website”) and any services, features, content, or applications offered by GoNetra (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, please do not access or use the Services.

1. Acceptance of Terms

By accessing, browsing, or using the Services, you affirm that you are at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. If you are under the age of majority in your jurisdiction, you may not access or use the Services.

You agree that, by accessing the Services, you have read, understood, and agree to be bound by all of these Terms and any additional guidelines, rules, or policies that we post on the Website. We may revise these Terms from time to time by updating this page; any changes will take effect upon posting, unless otherwise specified. 3. Account Registration and Security

  1. Account Creation. Certain features or areas of the Services may require you to register for an account (“Account”) and provide information about yourself. You agree to (a) provide accurate, current, and complete information during registration; and (b) maintain and promptly update your Account information to keep it accurate, current, and complete.
  2. Account Security. You are responsible for safeguarding your password and any other credentials used to access your Account. You agree not to share your password or other credentials with any third party. You are solely responsible for any activity that occurs under your Account. You agree to notify us immediately of any unauthorized use of your Account or any other breach of security.
  3. Account Termination. We reserve the right to disable or terminate your Account at any time, with or without notice, for any or no reason, including if we believe that you have violated these Terms.

4. Use of the Services

  1. Eligibility. You must be at least 18 years old to access or use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
  2. Permitted Use. You may use the Services only for lawful purposes and in accordance with these Terms. Except as expressly permitted by GoNetra, you agree not to copy, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content or materials made available through the Services, except as expressly permitted in writing by GoNetra.
  3. Prohibited Conduct. You agree not to engage in any of the following prohibited activities:
    • Violating any applicable local, state, national, or international law or regulation.
    • Infringing or misappropriating any third-party intellectual property or privacy rights.
    • Uploading, posting, or transmitting any content that is unlawful, defamatory, libelous, obscene, pornographic, harassing, abusive, threatening, invasive of privacy, or otherwise objectionable.
    • Uploading, posting, or transmitting any viruses, worms, malware, or other harmful code.
    • Attempting to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services.
    • Interfering with or disrupting the integrity or performance of the Services.
    • Using any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.
    • Collecting or harvesting any personally identifiable information from the Services, except as expressly permitted by GoNetra.
  4. Suspension and Termination. We reserve the right to suspend or terminate your access to the Services, or remove any content, at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users or GoNetra’s interests.

5. User Content

  1. Definition. “User Content” means any text, images, videos, or other content that you upload, post, or otherwise make available through the Services.
  2. Ownership. You retain all rights and ownership in and to your User Content. By submitting User Content to the Services, you grant GoNetra a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and providing the Services.
  3. Responsibility. You are solely responsible for your User Content. You represent and warrant that you either own all rights to your User Content or have secured all necessary rights and permissions for us to use it in the manner described in these Terms.
  4. Moderation. We may, but are not obligated to, review, monitor, or remove User Content that we determine, in our sole discretion, to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable or in violation of these Terms.

6. Intellectual Property Rights

  1. Our Content. All content, trademarks, service marks, logos, and other intellectual property displayed on the Services, excluding User Content, are the property of GoNetra or its licensors and are protected by copyright, trademark, and other intellectual property laws.
  2. Limited License. Subject to your compliance with these Terms, GoNetra grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include any resale or commercial use; any derivative use; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering or extraction tools.
  3. Feedback. If you provide comments or suggestions regarding the Services (“Feedback”), you grant GoNetra a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and otherwise exploit such Feedback for any purpose.

7. Third-Party Links and Services

The Services may contain links to third-party websites, products, or services that are not owned or controlled by GoNetra. We are not responsible for and do not endorse any such third-party websites, products, or services. If you access any third-party site, you do so at your own risk, and you agree that GoNetra is not responsible or liable for any content, advertising, products, or other materials on or available from such sites. Your correspondence or business dealings with any third parties found on or through the Services are solely between you and the third party.

8. Payment, Billing, and Subscriptions

  1. Fees. Some parts of the Services may be offered for a fee or other charge. You agree to pay all fees or charges associated with your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.
  2. Billing Information. You agree to provide current, complete, and accurate billing information for all purchases made via the Services. By providing a payment method, you authorize GoNetra to charge any such payment method. If your payment method is declined, we may suspend or cancel your access to paid features until you provide a valid payment method.
  3. Refund Policy. Unless otherwise stated, all fees are non-refundable. Any refund requests must be submitted in writing to [email protected] and will be handled on a case-by-case basis at our discretion.
  4. Subscription Terms. If you subscribe to a recurring service (e.g., a monthly or annual subscription), your subscription will automatically renew at the end of each term, unless you cancel before the renewal date. You may cancel by accessing your Account settings and following the cancellation instructions. Cancellation will take effect at the end of the then-current billing cycle, and you will not receive a prorated refund for any unused portion of the cycle.

9. Disclaimers

  1. No Warranty. THE SERVICES AND ALL CONTENT, MATERIALS, AND INFORMATION PROVIDED ON OR THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. GO NETRA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  2. No Professional Advice. The Services may provide general information but do not constitute professional, financial, medical, or legal advice. You should consult appropriate professionals for advice specific to your situation.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GONETRA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, ATTORNEYS’ FEES, LOST PROFITS, AND LOSS OF BUSINESS) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICES, EVEN IF GONETRA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL GONETRA’S TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless GoNetra, its affiliates, and their respective officers, directors, employees, agents, successors, and assigns from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  • Your violation of these Terms;
  • Your User Content or your use of the Services;
  • Your infringement of any third party’s rights, including intellectual property rights or privacy rights;
  • Your violation of any applicable law, regulation, or rights of any third party.

12. Governing Law and Dispute Resolution

  1. Governing Law. These Terms and any dispute arising out of or related to the Services will be governed by and construed in accordance with the laws of the [State or Country of Incorporation], without regard to its conflict of law principles.
  2. Informal Resolution. Before filing a formal claim or lawsuit, you agree to try to resolve the dispute informally by sending a written notice of your claim to GoNetra at the contact information in Section 15.   3. Arbitration. Any dispute that cannot be resolved informally will be settled exclusively by binding arbitration before a single arbitrator conducted under the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration provider. The arbitration will be held in [City, State/Country], and judgment on the arbitration award may be entered in any court of competent jurisdiction. You and GoNetra agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
  4. Small Claims Court. Notwithstanding the foregoing, either party may bring an individual claim in small claims court if it qualifies.

13. Termination

  1. Our Termination Rights. We reserve the right, in our sole discretion and without notice or liability, to suspend or terminate your access to all or part of the Services at any time, for any reason, including for breach of these Terms.
  2. Effect of Termination. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination (including ownership provisions, warranty disclaimers, indemnity, and limitations of liability) will survive.

14. Electronic Communications

When you use the Services or send e-mails, you are communicating with us electronically. You consent to receive communications from us electronically, such as e-mail, SMS/text, or notices posted on the Website. You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.

15. Miscellaneous

  1. Entire Agreement. These Terms, together with the Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and GoNetra concerning your use of the Services and supersede all prior or contemporaneous communications and proposals, whether oral, written, or electronic, between you and GoNetra.
  2. Waiver and Severability. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
  3. Assignment. You may not assign or transfer your rights or obligations under these Terms without GoNetra’s prior written consent. We may assign or transfer our rights and obligations at any time without restriction.
  4. Force Majeure. GoNetra will not be liable or responsible for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, pandemics, wars, acts of terrorism, riots, labor disputes, governmental actions, or failures of telecommunications or digital infrastructure.
  5. No Third-Party Beneficiaries. These Terms do not and are not intended to confer any rights or remedies upon any person other than you and GoNetra and our respective successors and permitted assigns.
